There are several advantages to using a private judge rather than a sitting judge in court
  1. Parties are able to select the person with the right qualifications and experience to handle the matter.

  2. Disputes can be resolved in a confidential manner.

  3. There is assurance that the matter will be handled when first scheduled and not continued because the Court's calendar is too crowded.

  4. While the parties usually split the costs of the private judge in some fair fashion, the ultimate cost to the parties can often be less than full litigation in court, as mediation and arbitration can usually be done earlier than a case can be tried; there is no need to re-prepare the case by the lawyers and witnesses when the matter is continued in court; and private judges can be engaged to put in a full day on their matters rather than having to juggle several matters each day as is typical in court.

    2. Some private judges can be engaged through various service providers who administer the cases, splitting the total fees with the private judge. Of these providers, some require the judge to be exclusive to them, others allow the judge to work independently and with a number of providers.
